1. Owner of the Service

1.1. The Service is provided by Pavel Lezhenin, a self-employed professional (empresario individual) established in Spain, who is the Operator referred to in the Terms of Service, the Privacy Policy, the EULA and the Cookie Policy.

1.3. Place of establishment: 46021 Valencia, province of Valencia, Spain. The full postal address is provided on request sent to info@skagry.com.

1.4. Activity: development and operation of online computer games and of the services provided through them.

1.5. Contact: info@skagry.com, which receives any enquiry concerning the Service and the notices, requests and complaints described in the other documents, and support@skagry.com for help with an Account. Both addresses reach the Operator directly.

1.6. This notice is published in compliance with Article 10 of Act 34/2002 of 11 July on information society services and electronic commerce (LSSI-CE).

2. The website and where it runs

2.1. The domain skagry.com is registered through Vercel Inc. (340 S Lemon Ave #4133, Walnut, CA 91789, United States), which also operates the domain’s name servers.

2.2. The game servers and their databases are hosted by Fly.io (Fly.io, Inc., San Francisco, California, United States) in the European Union, Paris region.

2.3. The sandbox at sandbox.skagry.com, which runs in the visitor’s browser, is hosted by Vercel Inc.

2.4. The other providers that take part in the Service, and what each of them processes, are listed in the Privacy Policy.

3. Content and intellectual property

3.1. The Service, its name, its graphics, texts, sounds, databases and software are protected by intellectual property law and belong to the Operator or to its licensors.

3.2. The license granted to a User, and its limits, are set out in the EULA. No other reproduction, distribution, public communication or transformation of the Service is permitted without the written authorization of the Operator.

3.3. Third-party material included in the Service is used under the license granted by its author, and the attributions those licenses require are given with the material.

3.4. The Service cites published scientific work and names observatories, space agencies and research institutions as the sources of the astronomical data it is built on. A citation identifies a source and nothing more: it implies no affiliation with, endorsement by or sponsorship from the persons or institutions named, and no name or trade mark of theirs is used as a sign of the Operator or of the Service.

4. Links to other websites

4.1. The Service links to websites operated by third parties. The Operator does not control their content and assumes no responsibility for it; a link is not a recommendation of the site it points to.

4.2. A link that leads to unlawful or harmful content may be reported to info@skagry.com, stating where the link appears. Notices concerning content published within the Service itself are governed by the Terms of Service.

5. Applicable law and disputes

5.1. The use of this website and of the Service is governed by Spanish law.

5.2. Where the User is a consumer, the courts of the User’s place of residence within the European Union are competent and the mandatory consumer protection rules of that place apply; the dispute resolution clauses of the Terms of Service apply in full.

5.3. Before going to court, a consumer may address a complaint to info@skagry.com, which the Operator undertakes to answer within one month; a consumer resident in Spain may also apply to the consumer arbitration boards (Juntas Arbitrales de Consumo) or to the consumer protection authority of their autonomous community.
